These terms of use are entered into by and between you (“Customer,” “you,” “yours,” or similar terms) and Banco San Juan Internacional, Inc. (“BSJI,” “us,” “our,” or similar terms). The following terms and conditions (the “Terms of Use”), govern your use of the mobile application owned by MIDI Technologies LLC and licensed to BSJI (the “MiDi App”) and any products or services offered by BSJI through the MiDi App (“Products”) or by a third party provider that we make available to you through the MiDi App (“Third Party Services”). Your acceptance of these Terms of Use is required to use the MiDi App and to obtain any Product or Third Party Service offered on the MiDi App.
BY ACTIVATING, DOWNLOADING, OR USING THE MIDI APP, YOU (A) ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THESE TERMS OF USE; (B) REPRESENT THAT YOU ARE 18 YEARS OF AGE OR OLDER/OF LEGAL AGE TO ENTER INTO A BINDING AGREEMENT; AND (C) ACCEPT THESE TERMS OF USE AND AGREE THAT YOU ARE LEGALLY BOUND BY ITS TERMS. IF YOU DO NOT AGREE TO THESE TERMS OF USE, DO NOT ACCESS OR USE THE MIDI APP AND DELETE IT FROM YOUR MOBILE DEVICE (AS DEFINED BELOW).
Please note that your use of the MiDi App, including for example the provision of any depository account services through BSJI, are subject to additional terms and policies for that Product or Third Party Service. In the event of a conflict between these Terms of Use and the terms of any Product or Third Party Service, the terms of the Product or Third Party Service shall control to the extent of its subject matter. Some functionality of the Products and Third Party Services will involve the collection and transmission of information that personally identifies you, including information that we obtain directly from the mobile device owned or otherwise controlled by you (“Mobile Device”). BSJI may use automatic means (including, for example, cookies and web beacons) to collect such information. All information we collect on the MiDi App is subject to our Privacy Policy, available at [https://en.bsji.com/ps/privacy/]. By using the MiDi App, you consent to all actions taken by us with respect to your information in compliance with the Privacy Policy. Please review our Privacy Policy and any privacy notice or disclosure relating to a Product or Third Party Service you apply for or obtain through the MiDi App for more information about how we or our third party providers collect, use and share your Personal Information.
BSJI may revise these Terms of Use at any time. All changes are effective immediately upon posting and apply thereafter. Continued use signifies acceptance. Please review them regularly.
You must be at least 18 years old to use the MiDi App. It may only be used outside Puerto Rico. Use is at your own risk, and you must comply with all applicable laws.
BSJI grants you a personal, non-exclusive, non-transferable license to download, install, and use the MiDi App on a single Mobile Device and access services through it in accordance with these Terms of Use.
You do not acquire any ownership rights. BSJI and its licensors retain all rights, titles, and interest in the MiDi App.
You agree not to:
Violate laws or regulations.
Sell, license, or exploit the MiDi App or its content.
Modify, reverse engineer, or copy the software.
Harm or interfere with the MiDi App or servers.
Use the MiDi App in ways that breach third-party terms or these Terms of Use.
The MiDi App may link to third-party resources. BSJI is not responsible for their content or any loss resulting from use.
Third Party Services may be available through the MiDi App. BSJI does not warrant or monitor them and may disable them at any time.
BSJI may provide updates that modify features. You must install updates for proper functioning. All updates are part of the MiDi App and subject to these Terms.
BSJI may suspend or terminate your license or access to the MiDi App or any Product/Service at any time, with or without notice. You must delete all copies upon termination.
The MiDi App and its contents are protected by intellectual property laws. The “BSJI,” “MiDi,” and related marks are owned or licensed by BSJI. Do not use them without permission.
We do not guarantee that the MiDi App is virus-free. Use is at your own risk. The MiDi App is provided “as is” and “as available” without warranties of any kind. BSJI disclaims all implied warranties, including merchantability, fitness for purpose, and non-infringement.
BSJI shall not be liable for any damages (direct or indirect) arising from use or inability to use the MiDi App or related content/services, even if advised of the possibility.
You agree to indemnify and hold BSJI and its affiliates harmless from any claims, damages, or losses arising from your violation of these Terms or misuse of the MiDi App.
These Terms are governed by the laws of the Commonwealth of Puerto Rico.
No waiver of any term is deemed continuing. If any provision is deemed unenforceable, the rest remain in effect.
